This shall confirm the agreement between the Contestant/participant/ guest hereby referred to as “Guest” and 3 TAMIL TV hereby referred to as “3 TAMIL TV” in connection with the 3 TAMIL Productions. For good and valuable consideration, the receipt of which is hereby acknowledged, 3 TAMIL TV and Guest agree as follows:

SCREEN CREDIT: Unless otherwise specified in the terms, screen credit is at 3 TAMIL TV’s discretion subject to Guest’s performance.

NO WAIVER: The terms and conditions are binding for 3 TAMIL TV and Guest and shall not be waived or altered by any method. Any added conditions on the front of this, inconsistent with these conditions of production services shall be null and void.

All results and proceeds of Guest ‘s services will be deemed to be a voluntary service specially commissioned by and for 3 Tamil TV within the meaning of the copyright laws of Australia. or any similar or analogous law or statute of any other jurisdiction. Accordingly, 3 TAMIL TV will be the sole and exclusive owner of the Results for all purposes, including, with the right to exploit the Results in the Program and otherwise in connection with the distribution, exhibition, advertising and exploitation of the Program or any part of the foregoing in any and all media and by any and all means, now known or hereafter devised, throughout the universe in perpetuity.

3 TAMIL TV is not responsible for workplace injuries and they are not responsible for workers comp, insurance, etc. The location is also not liable for injuries caused during filming. The location’s insurance will not cover any injuries.

The parties acknowledge that the production is not responsible for the theft, loss and/or damage of Guest’s personal property or box rental items. 3 TAMIL TV shall have the right to use Guest ‘s name, voice, picture, video and likeness in connection with the productions, the advertising and publicizing thereof, and any promotional videos or clips respecting the production without any compensation, therefore. Guest shall not directly or indirectly circulate, publish or otherwise disseminate any news story, article, book, blog, social networking services or other publicity concerning 3 TAMIL TV’s productions/videos/intellectual property, the Guest ‘s or others’ services, without 3 TAMIL TV’s prior written consent. Admittance of any non-contracted guests to the set is at the sole discretion of the 3 TAMIL TV. In no event will Guest be entitled to seek injunctive or other equitable relief nor will Guest have the right to enjoin the production, exhibition, or other exploitation of the Program. Furthermore, Guest will not have the right to terminate the rights granted under this Agreement or rescind this Agreement by reason of such breach. This Agreement constitutes the entire understanding between 3 TAMIL TV and Guest with respect to the subject matter of this Agreement and cannot be modified except by a written amendment signed by 3 TAMIL TV

NO OBLIGATION TO PRODUCE: 3 TAMIL TV will not be obligated to produce or release the Film, or to use the results of Guest’s services.

ASSIGNMENT: 3 TAMIL TV shall have the right to transfer or assign its rights and obligations pursuant to the terms to any other person, firm, or corporation, and upon such assignment shall be relieved of its obligation to Guest.

HOLD HARMLESS: Guest shall indemnify and hold 3 TAMIL TV harmless from and against any and all loss, claim, liability, judgment, cost or expense suffered by Guest for any breach or default of the terms.

 

Contest/Competition:

The production/ video, its description and name you provide will be used for that specific competition and promotion and will be shared on 3Tamil TV digital platforms including but not limited to Website, Facebook, YouTube, Instagram etc.

The Organizers reserves the right to disqualify a participant if he/she/they have provided false/misleading information.

By entering into a contest, you understand and agree that 3Tamil TV or anyone acting on behalf of 3Tamil Tv shall have the right, where permitted by law, to print, publish, broadcast, distribute, and use in any media now known or hereafter developed, in perpetuity and throughout the world, without limitation, your entry, name, portrait, picture, voice, likeness, image, videos, statements about the campaign, and biographical information for news, publicity, information, trade, advertising, public relations, and promotional purposes. Without any further compensation, notice, review, or consent.

By entering a contest, you represent and warrant that your entry does not violate any third party’s proprietary or intellectual property rights. If your entry infringes upon the intellectual property right of another, you will be disqualified at the sole discretion of 3Tamil Tv. If the content of your entry is claimed to

constitute infringement of any proprietary or intellectual proprietary rights of any third party, you shall, at your sole expense, defend or settle against such claims. You shall indemnify, defend, and hold harmless 3Tamil Tv from and against any suit, proceeding, claims, liability, loss, damage, costs or expense, which 3Tamil Tv may incur, suffer, or be required to pay arising out of such infringement or suspected infringement of any third party’s right.

3Tamil Tv reserves the right to modify or substitute any of these Terms & Conditions of the competition from time to time

Any update on the competition rules or prize rewards if any will be only notified on the 3Tamil Tv Facebook page.

3Tamil Tv decision in relation to all matters affecting the contest is final.

In the event of Winners being determined through Voting, the following criteria applies but are not limited to.

I. Total number of Likes, Unique Shares and Votes till the set date are a part of but not the only factors being considered

II. The likes and shares each video receive are subject to verification by 3Tamil Tv administrators and must meet all eligibility requirements before being confirmed as a winner of the prize.

III. 3Tamil Tv and its authorized contractors, reserve the right to verify the validity of all votes and to disqualify any performance that 3Tamil Tv determines has tampered with the voting process or in the opinion of 3Tamil Tv engaged in any unlawful or other improper misconduct, a conduct damaging to the goodwill, integrity or reputation of the 3Tamil Tv awards or 3Tamil Tv.

IV. Paid promotions are not allowed and if found will be disqualified.

V. Participants may be disqualified if found to be disrespectful which includes, but is not limited to, acts or conducts such as using profane or inappropriate language or gestures, and baiting or taunting an opponent which is intended to demean others on the basis of race, religion, gender, etc.

VI. If for any reason this voting process is not capable of running as planned, including due to tampering, unauthorized intervention, fraud, technical failures or any causes beyond the control of 3Tamil Tv, which corrupt or affect the administration, security, fairness or integrity or proper conduct of the voting process, then 3Tamil Tv reserves the right in its sole discretion to take any action that may be available and/or to cancel, terminate, modify or suspend the voting process

VII. If for any reason, the voting process is interrupted in any way, or for any other reason that 3Tamil Tv determines in its sole discretion to be reasonably necessary, 3Tamil Tv reserves the right to select the winner, taking into consideration the number of votes received until the time of the interruption or cancelation of the voting process and the judge’s marks.

    a. 3Tamil Tv reserves the right to change the voting period if necessary.

    b. All approved videos for competition will be posted on the 3Tamil Tv Facebook Page and will be subject to voting during the voting period

VIII. 3Tamil Tv reserve the right to collect personal information about the voter for the purposes of conducting this public voting process, if required, as a security feature to minimize voter fraud.

3Tamil Tv and its associated agencies, members and sponsors, will not be liable for any loss or damage whatsoever which is suffered (including but not limited to indirect or consequential loss) or for any personal injury suffered or sustained in connection with the voting process except for any liability which cannot be excluded by law.

3Tamil Tv reserves the right to amend these Terms & Conditions at any time

These Terms & Conditions are governed by the laws of the State of Victoria, Australia.

By registering for competition, the participants/Guests agree to the Terms and Conditions contained herein.
